OFFICIAL RULES
1. HOW TO ENTER: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE A PARTICIPANT'S CHANCES OF WINNING. The SCA Tissue North America, LLC ("Company") GreenOurSchool Sweepstakes ("Contest") begins April 22, 2008 (Earth Day) at 12:00 p.m. CT and ends at 12:00 p.m. CT on November 30, 2008. Enter by filling out the entry form included in collateral materials related to the contest available through the Company, its distributors, brokers or customers or simply use the online entry form as directed at www.GreenOurSchoolProgram.com. Entrants must complete all data requested on the online survey form. Limit one entry per school. Incomplete entries are void. All entries become the property of Company and will not be acknowledged or returned. The Contest will consist of one drawing among entries completed and received by Company not later than November 30, 2008 at 12:00 p.m. No late entries will be accepted. Company assumes no responsibility for lost, late, misdirected, undelivered, illegible, or mutilated entries or for any computer, online, telephone, cable network, electronic or Internet hardware or software malfunctions, failures, connections, availability, garbled or jumbled transmissions, service provider, Internet, website, or other accessibility or availability issues, traffic congestion, or unauthorized human intervention, or any technical malfunctions that may occur.
2. ELIGIBILITY: This Contest is open to all schools K-12 in the U.S. and Canada (excluding Quebec) (referred to as "School" or "Schools"). Only one entry will be accepted per School and each entry must be submitted through the School's food service director. Individuals submitting an entry on behalf of a School are referred herein as "Participants".. All Participants must be 19 years of age or older as of the date the Contest begins. Employees of Company, its vendors, subsidiaries, affiliates, prize suppliers, and advertising and promotional agencies of Company, and their immediate families (spouse, parents, children, siblings and their spouses) and individuals living in the same household as such employees are ineligible to serve as Participants. This Contest is governed by the laws of the United States and is subject to all applicable federal, state, and local laws and regulations. The Contest shall be void where prohibited by law. In the event that the Grand Prize is awarded to a School in a location where the Contest is prohibited by law, as determined by Company in its sole discretion, the prize shall be redrawn and another Grand Prize Winner selected.
3. JUDGING: The Grand Prize Winner will be selected by random drawing on or about 12 p.m., November 30, 2008, from all eligible entries received by November 30, 2008. The Grand Prize drawing will be conducted at and by Directions Incorporated, 600 S. Commercial St, Neenah, WI 54956. All Participants and the Schools they represent agree to be bound by these Official Rules and all decisions of the judges, which shall be final and binding in all respects. Odds of winning depend on total number of eligible entries received. No more than one Grand Prize Winner is eligible. The principal of the School selected as the Grand Prize Winner must consent to award of the Grand Prize to his/her School. The Grand Prize Winner will be notified via e-mail, telephone, or in person on or before December 2, 2008, and the Grand Prize Winner must contact Company to claim prize no later than December 15, 2008. If the Grand Prize remains unclaimed beyond such date, an alternate winner will be selected. In the event a Canadian School is selected as the Grand Prize Winner, the Participant representing that School will be required to answer a skill-testing question before the Grand Prize may be awarded or accepted. Failure to answer the question correctly will disqualify the School represented by such Participant and will result in forfeiture of the Grand Prize.
4. PRIZES: Subject to the terms and conditions set forth herein, the School selected as the Grand Prize Winner will be eligible to receive a school "make over" valued at $5,000. To receive the Grand Prize, the winning School must develop and submit to Company and its panel of experts a written proposal for use of the Grand Prize in support of a project to improve the environmental footprint or impact of the winning School (the "Winning Project"). The Grand Prize will only be finally awarded when Company and its panel of experts approves the proposal submitted by the winning School. Company reserves the right to dispense the proceeds of the Grand Prize during the course of the Winning Project.
5. DELIVERY: The Grand Prize Winner must take delivery of the prize as instructed by Company. All other costs related to acceptance and use of the prize proceeds are the responsibility of the Grand Prize Winner, including but not limited to all taxes, registration, and insurance fees as well as all other costs involved in using, redeeming or claiming the Grand Prize. The Grand Prize is non-transferable and no prize substitution will be allowed, except at Company's sole discretion.
6. CONSENT: The following will apply: 1) the principal of the winning School will be required to complete and return, within a specified time period, a W-9 form, and an affidavit of eligibility, and a liability/publicity release waiver for use of Grand Prize Winner's name and likeness for advertising/promotion purposes for no compensation or consideration (where permitted); 2) the principal of the School must consent to the award of the Grand Prize to his/her School; 4) the Grand Prize Winner will be issued an IRS Form 1099 reflecting the value of the Grand Prize; 5) the Grand Prize Winner will be responsible for paying all income taxes on the Grand Prize. Failure to collect or properly claim the Grand Prize in accordance with these rules will result in forfeiture of the prize. If forfeited for any reason, the winning School will not receive any other prize substitution or compensation, and the prize will be awarded to an alternate winner.
7. DATA COLLECTION: Company will collect information from Participants and the Schools they represent upon entry into the Contest. See Company's privacy policy at www.GreenOurSchoolProgram.com and for information about how information may be used.
8. CONTEST E-MAILS: By enrolling in the GreenOurSchool Contest, each Participant expressly agrees to periodically receive Contest e-mails from the GreenOurSchool Contest. Any Participant representing a School enrolling in the GreenOurSchool Contest represents and warrants to Company that (a) the Participant has received the express authorization on behalf of the Principal of the School which he/she represents to enroll in this Contest; (b) the individual has received express consent from the Principal of the School which he/she represents to receive the Grand Prize, if awarded to the School; and (c) the individual's participation in Contest does not conflict with any contractual restrictions or obligations of the individual or the School to any other party, including to the individual's employer.
9. GENERAL CONDITIONS: All government, federal, state, provincial and local taxes, fees and surcharges on prize packages are the sole responsibility of the Grand Prize Winner. The Grand Prize Winner must grant Company the irrevocable right to use and publish its name, likeness, and state or province online and in print, or any other media, in connection with the Contest and in connection with advertising and promotional purposes including but not limited posting this information on the Company website. By entering, Participants, for themselves and on behalf of their Schools, release and hold harmless Company, its parents, subsidiaries, affiliates, directors, officers, employees, attorneys, agents and representatives from any and all liability for any injuries, loss, claim, action, demand or damage of any kind including without limitation, personal injuries, death and property damage; and claims based on publicity rights, defamation, or invasion of privacy; which you may suffer directly or indirectly arising from or in connection with the Contest or any prize won, any misuse or malfunction of any prize awarded, participation in any Contest-related activity, or participation in the Contest. As a condition of participating in this Contest, Participants, for themselves and on behalf of their Schools, agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively, before a court of competent jurisdiction located in Appleton Wisconsin, U.S.A., which court shall apply the laws of the State of Wisconsin without regard for rules or conflicts of law. Under no circumstances shall Participants or the Schools they represent be entitled to claim punitive, incidental, or consequential damages, or any other damages, including attorneys fees, other than Participant's or the School's actual out-of-pocket expenses (if any) associated with participation in the Contest, and Participants, for themselves and on behalf of their Schools, hereby waive all rights to have damages multiplied or increased. Before the winning School can receive the Grand Prize, an authorized representative of the winning School must sign and deliver to Company a release and waiver of claims in form satisfactory to Company containing the foregoing language, the language set forth in Section 10 below and such additional language of waiver, release and indemnity as Company shall require. ANY ATTEMPT BY SCHOOL AND/OR PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, COMPANY RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT OR SCHOOL TO THE FULLEST EXTENT PERMITTED BY LAW.
10. LIMITATIONS OF LIABILITY: Company is not responsible for any circumstances which impede or prevent a School or Participant from entering this Contest. Company is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions in the Contest, including but not limited to any misprints or typographical errors. Company assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation of transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of entries. Company is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to Participant's, a School's or to any other person's computer related to or resulting from participating or downloading materials in this Contest. Company is not responsible for any failure of any postal authority to deliver any entry on time or to the correct address. If, for any reason, the Contest is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of Company which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Company reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. By participating in this Contest, Participants, for themselves and on behalf of their Schools, agree to be bound by all of these rules and regulations. Company reserves the right to change the rules and regulations and/or cancel this Contest at any time, without notice.
IN NO EVENT WILL COMPANY, ITS PARENTS, AFFILIATES, SUBSIDIARIES, AND RELATED COMPANIES, ITS ADVERTISING AND PROMOTIONAL AGENCIES, OR ITS DIRECTORS, OFFICERS, EMPLOYEES, ATTORNEYS, AGENTS AND REPRESENTATIVES, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPANT'S OR THE SCHOOL'S PARTICIPATION IN THIS CONTEST, THE IMPLEMENTATION OF THE WINNING PROJECT AND/OR ACCESS TO AND USE OF ANY RELEVANT INTERNET SITE INCLUDING HTTP://www.GreenOurSchoolProgram.com OR THE DOWNLOADING FROM AND/OR PRINTING OF MATERIAL FROM ANY SAID SITE. WITHOUT LIMITING THE FOREGOING, ALL INFORMATION, WHETHER ELECTRONIC OR WRITTEN, IS PROVIDED ‘AS IS'. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO PARTICIPANTS OR THEIR SCHOOLS.
Company reserves the right, at its sole discretion, to terminate the Contest, to alter Contest rules, and to restrict, change, correct, or cancel the enrollment process, or any portion of the Contest at any time without prior notification for any reason including equipment failure, acts of nature or war, strikes, civil disturbances, economic circumstances, government policy or tax changes, error in Contest terms or operation, or fraud.
Company is not responsible for, and the winning School and its Participant agree to hold Company harmless from all disputes between employees of the winning School and the winning School.
11. WEB SITE USAGE: The following terms apply to all Schools and/or Participants (collectively "User(s)") who use or access the GreenOurSchool Contest website: www.GreenOurSchoolProgram.com (the "Web site"). If a User does not agree to these terms, User should not use the website.
